Compliance with spam law sinks further

An e-mail security software vendor reports that compliance with the federal Can Spam Act is at its lowest point since the law was enacted in January.

MX Logic Inc., in Denver, Colo., scanned various samplings of unsolicited commercial e-mail and found that compliance with Can Spam dropped from 3% in April to 1% in May.

The company also found that only 15% of pornographic e-mails sent over the past month complied with a new Federal Trade Commission (FTC) rule requiring such e-mail to be labeled "SEXUALLY-EXPLICIT:" in the subject line. The FTC rule went into effect May 19.

The Can Spam Act stipulates that people who send commercial e-mails with fake subject lines or false sender addresses can be punished with prison terms. It also gives the FTC new enforcement authority and the option to set up a national "do not spam" registry.
